RE: The tariff classification of gloves from China

Dear Ms. Keller:

In your letter dated September 10, 2002, on behalf of West Chester Holdings, Inc., you requested a classification ruling.

Three samples were received. Style BO1PDI is a clute cut glove made of 100% woven cotton fabric. The glove has a woven cuff. Style KG22SI is a lined clute cut glove with the shell made of 100% woven cotton flannel fabric. The glove has a rib knit cuff.

Style 98100 is a fully lined winter glove with a woven nylon shell. The glove features an overlaid palm and thumb patch, elasticized wrist, hook & clasp, fourchettes and a rib knit cuff. The inner surface of the shell fabric is covered with plastic foam. This coated material imparts the essential character of the glove.

The applicable subheading for styles BO1PDI and KG22SI will be 6216.00.3800 Harmonized Tariff Schedule of the United States (HTS), which provides for gloves, mittens and mitts: other: of cotton: other: without fourchettes. The duty rate will be 23.8 percent ad valorem. The applicable subheading for style 98100 will be 6216.00.2925 HTS which provides for gloves, mittens and mitts: impregnated, coated or covered with plastics or rubber: other: with fourchettes: containing 50 percent or more by weight of cotton, man-made fibers or any combination thereof, subject to man-made fiber restraints. The duty rate will be 13.4 percent ad valorem.

Styles BO1PDI and KG22SI fall within textile category designation 331, style 98100 falls within category 631. Based upon international textile trade agreements products China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
