RE: The tariff classification of an Easter Wreath Globe from China.

Dear Ms. Wierbicki:

In your letter dated September 12, 2002, on behalf of your client, Avon Products, Inc., you requested a tariff classification ruling.

The sample submitted, PP #250745, Easter Wreath Globe, consists of an egg shaped water globe set into an agglomerated stone base that measures approximately 7 inches in height and 5 inches in diameter. The water globe is constructed of clear glass and measures approximately 4 inches in height and 3 inches in diameter. It is filled with water and shimmering glitter and depicts a pastoral setting of four white rabbits, each with either a pink or purple bow around the neck, chasing one another around a basket filled with colored Easter eggs. The basket is set among white and yellow flowers and has a large butterfly on its handle. The base resembles a gazebo-like structure, decorated to match the globe’s Easter scene, replete with depictions of colored Easter eggs on the roof, as well as in the grass amongst baby chicks and flowers. The base and stand are made of plastic and polyresin material, incorporating a battery operated musical chip mechanism programmed to play “Here Comes Peter Cotton Tail” when the button on the underside is pressed. The article is intended as a decoration for the Easter holiday.

The applicable subheading for PP #250745, Easter Wreath Globe, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
