RE: The tariff classification of boa and headband set from Korea.

Dear Ms. Wierbicki:

In your letter dated September 13, 2002, on behalf of Avon Products, Inc., you requested a tariff classification ruling. As requested, the sample will be returned to you.

The submitted sample, style 248493 is described as a chenille scarf (boa) and headband that will be imported and packaged for retail sale together as a set. The boa and the headband are constructed of 100% polyester knit fabric.

The boa and headband meet all of the criteria for classification as a set. Neither component imparts the essential character. The boa would be classifiable under 6117.10 HTS and the headband under 6117.80 HTS. Classification will be pursuant to GRI 3 (c) under the heading which occurs last in numerical order in the HTS. Therefore, classification will be under the subheading 6117.80, HTS.

The applicable subheading for style 248493 will be 6117.80.8500, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up clothing accessories, knitted or crocheted; knitted or crocheted parts of garments or clothing accessories: other accessories: other: headbands, ponytail holders and similar articles. The rate of duty will be 14.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
