RE: The tariff classification of belts from Taiwan and/or China.

Dear Mr. Ralston:

In your letter dated September 12, 2002, on behalf of Belgo Lux, you requested a tariff classification ruling. As requested the samples will be returned to you.

The submitted samples are Styles 61581, 61674, 62353, 61903M and 62362 Belts. Style 61581Belt is constructed of woven 100% nylon fabric with a metal fastener. Style 61674 Belt is constructed of 100% cotton macramé with a self-fabric loop and tassels. Style 62353 Belt is constructed of macramé of an unknown textile fiber with decorative wooden beads and tassels at either end. Style 61903M Belt is constructed of cotton and wooden beads. The cotton is braided at each end, and the major portion of the belt consists of wooden beads on textile fiber. The wooden beads impart the essential character of Style 61903M. Style 62362 Belt is stated to be constructed of 100% polyurethane with sequins; examination reveals a belt of constructed of sequin covered woven fabric with a fabric lining.

The applicable subheading for the Style 61581 Belt will be 6217.10.9530, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: Accessories: Other: Other, Of man-made fibers.” The rate of duty will be 14.8% ad valorem. The textile category designation is 659.

The applicable subheading for the Style 61674 Belt will be 6217.10.9510, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: Accessories: Other: Other, Of cotton.” The rate of duty will be 14.8% ad valorem. The textile category designation is 359.

The applicable subheading for the Style 61903M Belt will be 4421.90.9740, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other articles of wood: Other: Other: Other, Other.” The rate of duty will be 3.3%.

The applicable subheading for the Styles 62353 and 62362 Belts will be 6217.10.95, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: Accessories: Other: Other” The rate of duty will be 14.8% ad valorem. The textile category designation will depend on the fiber content of the belt.

Based upon international textile trade agreements products of Taiwan and China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
