RE: The tariff classification of two plastic toy figures from China.

Dear Mr. Tomenga:

In your letter dated August 30, 2002, on behalf of your client, Creata Promotion USA, Inc., you requested a tariff classification ruling.

You submitted the following samples.

Wrin #07918-006, Female Figure with Blue Hair, depicts a 5 inch female figure with black eyes, pink cheeks, red lips, long blue wavy hair, and wearing a blue top and blue satin-like skirt. The figure’s head and torso are made from hard plastic and her limbs are made from soft plastic, which allows the arms to rotate 360 degrees.

Wrin #07918-009, Male Figure with Animal-Like Face, depicts a 5-1/2 inch male plastic figure with animal-like facial features (protruding mouth, brown nose, blue eyes, furry eyebrows and furry whiskers). The figure is wearing a white wig tied in a bow, and dressed in a black hat, black suit with white accents and white cuffs, black vest with six white buttons, and black shoes with white buckles. The figure’s arms and legs bend but do not rotate.

The applicable subheading for Wrin #07918-006, Female Figure with Blue Hair, will be 9502.10.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for “Dolls representing only human beings and parts and accessories thereof: Dolls, whether or not dressedOther.” The rate of duty will be free.

The applicable subheading for Wrin #07918-009, Male Figure with Animal-Like Face, will be 9503.49.0000, HTS, which provides for “Toys representing animals or non-human creatures (for example, robots and monsters) and parts and accessories thereof: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
