RE: The tariff classification of Cinderella Pretty as a Princess Fashions from China.

Dear Ms. Borges:

In your letter dated August 21, 2002, you requested a tariff classification ruling.

The submitted sample, Item #10253, Cinderella Pretty as a Princess Fashions, consists of a 4” plastic doll and approximately 20 plastic fashions and accessories packaged inside a vinyl heart shaped purse that measures approximately 9-1/4 inches in height x 10-1/2 inches in width x 2 inches in depth. The fashions include a ball gown, pink gown, wedding outfit, maid’s outfit, and nightgown. The accessories include shoes/slippers, gloves, and assorted handbags. The components are sized and marketed for use in play activities with the doll. The vinyl purse opens up to reveal a removable play environment complete with the castle stairs (made of cardboard) and the prince (made of cardboard). An attached story booklet encourages the child to play out the classic story of Cinderella, including the scene where Cinderella runs home at the strike of midnight and leaves her glass slipper behind. The purse has a zipper closure with textile carrying handles. All components will be imported packaged inside the purse for retail sale. Although packaged together, this office does not consider the purse normal and usual packing for the doll. Therefore, the purse will be classified separately from its contents.

The applicable subheading for the purse of Item #10253, Cinderella Pretty as a Princess Fashions, will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Travel, sports and similar bags: With outer surface of sheeting of plastic or of textile materials: Other.” The rate of duty will be 20 percent ad valorem.

The applicable subheading for the doll and her clothing/accessories of Item #10253, Cinderella Pretty as a Princess Fashions, will be 9502.10.0060, HTS, which provides for “Dolls representing only human beings and parts and accessories thereof: Dolls, whether or not dressedOther.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
