RE: The tariff classification of the Survivor Pak from China.

Dear Ms. Mullins:

In your letter dated August 14, 2002, you requested a ruling on behalf of Crown Marketing Group on tariff classification.

The merchandise is the Survivor Pak, item # 321011A. The pack contains a hunting knife, a multi-purpose tool with blade, a flashlight, a monocular, and a compass in a fitted pouch. The hunting knife appears to have a rubber or plastic handle.

The applicable subheading for the hunting knife will be 8211.92.4050, Harmonized Tariff Schedule of the United States (HTS), which provides for other knives having fixed blades, with rubber or plastic handles, other. The general rate of duty will be 1 cent each plus 4.6 percent ad valorem.

The applicable subheading for the multi-purpose tool will be 8211.93.0030, HTS, which provides for knives having other than fixed blades. The general rate of duty will be 3 cents each plus 5.4 percent ad valorem.

The applicable subheading for the flashlight will be 8513.10.2000, HTS, which provides for portable electric lamps designed to function by their own source of energy (for example, dry batteries, storage batteries, magnetos), other than lighting equipment of heading 8512; parts thereof: lamps: flashlights. The rate of duty will be 12.5% ad valorem.

The applicable subheading for the monocular will be 9005.80.4040, HTS, which provides for other instruments; optical telescopes; other. The general rate of duty will be 8 percent ad valorem.

The applicable subheading for the compass will be 9014.10.9000, HTS, which provides for non-electrical, non-gyroscopic, non-optical, direction finding compass. The general rate of duty will be 2.9 percent ad valorem.

The pouch is considered a container specially shaped or fitted to contain the contents of the Survivor Pak and is to be entered with the articles for which they are intended. Consequently, when this specially fitted case is entered with the items for which they are intended they meet the requirements of GRI 5(a) and should be classified with the kits.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
