RE: The tariff classification of three decorative glass articles from China

Dear Ms. Liu:

In your letter dated August 12, 2002, you requested a tariff classification ruling. Three representative samples were submitted and will be returned to you as requested.

The first sample, which is identified as C26F5642 – “Glass Suncatcher Garland with Hook in Colored Glass Snail Shaped Top”, is a decorative article consisting of a long string of two-sided mirrored pieces of glass and glass beads attached to a metal snail-shaped frame with hook. The central portion of the snail is composed of glass. This decorative glass article measures approximately 25 inches in length.

The second sample, which is identified as C26F5645 – “Glass Suncatcher Garland with Hook and Colored Glass Top Decoration”, is a decorative article consisting of a long string of two-sided mirrored pieces of glass and glass beads attached to a three and one-half inch round decorative glass article with a metal frame and hook. This decorative glass article measures approximately 25 inches in length.

The last sample, which is identified as C26F5647 – “Glass Suncatcher Garland with Hook in Wired Flower Shape”, is a decorative article consisting of a long string of two-sided mirrored pieces of glass and glass beads attached to a metal flower with hook. This decorative glass article measures approximately 25 inches in length.

You indicated in your letter that the unit value of each style is $0.90.

The applicable subheading for the three decorative glass articles will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes: other glassware: other: other: valued over $0.30 but not over $3.00 each. The rate of duty will be 30 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
