RE: The tariff classification of a woman’s knit blouse from Hong Kong or China.

Dear Mr. Moser:

In your letter dated August 9, 2002, you requested a classification ruling for a woman’s knit garment on behalf of Teri Jon Sports, Inc. The sample is being retained for instructional purposes.

Style 3241T is a woman’s pullover blouse constructed from 100 percent cotton jersey knit fabric and 100 percent nylon mesh fabric. The jersey knit fabric has more than ten stitches per centimeter measured in both the horizontal and vertical directions. The long sleeve garment features a stand up collar with a 5 button opening at the back; and a hemmed bottom. The jersey layer is decorated with beading, decorative yarn, and lace like narrow fabric. The jersey layer of the blouse is completely covered with the mesh fabric. The mesh fabric also has a ruffle extending from the top of the collar to the hem.

As noted above, the garment is made up of two different types of fabric. Such garments are considered a composite good, with the classification determined by the fabric that provides the essential character. In this case, the jersey knit fabric provides the essential character. Since the jersey knit fabric is 100 percent cotton, and has more than 10 stitches per centimeter measured in both directions, the garment is considered to be a cotton knit blouse.

The applicable subheading for style 3241T will be 6106.10.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’sblousesknitted or crocheted: Of cotton. The duty rate will be 20% ad valorem.

Style 3241T falls within textile category designation 339. Based upon international textile trade agreements products of China and Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
