RE: The tariff classification of portfolios from China

Dear Ms. Snipes:

In your letter dated August 12th, 2002 you requested a tariff classification ruling. The request is on behalf of Gold Bond, Inc., 5845 Hixson Pike, Hixson, TN 37343.

Three samples, identified by style numbers LCV-800, LCV-150, MCM-800, and PCI-500 were submitted. The samples are portfolios designed to contain papers and other related articles. The samples will be returned as requested.

Items LCV-800 and MCM-800 measure 14 ½”W x 11 ½”H x 2”D and are made of vinyl plastic sheeting. They have a zippered closure on the main compartment. Front pockets are secured with flaps that are closed by elastic metal button closures. The items also feature removable shoulder straps. On the inside there are 1 ½” three ring binders, writing pads, and several other organizing pockets.

Items PCI-150 and LCV-150, also made of vinyl sheeting, measure 14 ¼”W x 11 ½”H x 2”D and have zippered closures on the main compartments. The items have retractable handles and pockets on both the front and back panels. The interior left panels consist of several different organizing compartments. There are 1 ½” three ring binders in the middle of these portfolios and writing pads on the right panels.

The applicable subheading for the portfolios will be 4202.12.2035, Harmonized Tariff Schedule of the United States (HTS), which provides, in part, for attache cases, briefcases, and similar containers, with outer surface of sheeting of plastics, other. The rate of duty will be 20 per cent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
