RE: The tariff classification of porcelain statuettes, copper tableware and copper jewelry from South Africa

Dear Ms. Ringelmann:

In your letter dated July 24, 2002, you requested a tariff classification ruling.

The articles are identified as follows:

Porcelain statuettes

Copper tableware consisting of salad servers, napkin rings and cake lifters each made of copper, brass and stainless steel.

Copper jewelry consisting of bangles, earrings, brooches, hairclips and chokers/necklace each made of copper, brass and stainless steel.

The applicable subheading for the porcelain statuettes will be 6913.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for other statuettes of porcelain or china. The duty rate will be free.

The applicable subheading for the copper cake lifters will be 8215.99.5000, HTS, which provides for cake servers of base metal. The rate of duty will be 5.3 percent ad valorem.

The applicable subheading for the copper jewelry will be 7117.19.9000, HTS, which provides for other imitation jewelry of base metal. The rate of duty will be 11 percent ad valorem

Articles classifiable under subheadings 8215.99.5000 and 7117.19.9000, HTS, which are products of South Africa may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on “Files”, click on “search” and then enter a key word search for the term “T-GSP”.

Your inquiry does not provide enough information for us to give a classification ruling on the salad servers and napkin rings. Your request for a classification ruling should include the weight of each metal. When this information is available, you may wish to consider resubmission of your request on the salad servers and napkin rings. If you decide to resubmit your request, please include all of the material that we have returned to you

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
