RE: The tariff classification of a hydraulic fluid power pump part from Germany.

Dear Mr. Schau:

In your letter dated August 1, 2002 you requested a tariff classification ruling on behalf of your client Sauer-Danfoss (USA).

The article in question is identified as a steel “preload” tube, part number 345976, for a hydraulic fluid power pump. You indicate that the “preload” tube , which is a part of a displacement limiter kit, hydraulically limits the movement of the pump’s swashplate.. Descriptive information and a technical drawing were submitted.

The applicable subheading for the “preload” tube will be 8413.91.9050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for parts of hydraulic fluid power pumps. The rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
