RE: The tariff classification of pole hardware from China.

Dear Mr. Petres:

In your letter dated July 19, 2002, you requested a ruling on tariff classification.

The samples you provided are hardware, made of iron or steel and galvanized. They are used on utility poles.

The clevis consists of the clevis body, a cotter pin and the cotter key. The clevis body is a mild steel stamping. The item referred to as a cotter pin is mild steel. It has a rounded head, an unthreaded shank and a hole in the bottom to accommodate the cotter key. The cotter key is of stainless steel. An insulator will be added to the assembly and it will be used to suspend a power cable.

The pole top pin consists of two parts, the pole top pin body and a plastic thread for an insulator. The body is manufactured as a stamping. The plastic thread is molded onto the top.

The guy clamps are used to secure the ends of guy cables to either an earth anchor or a utility pole. The cable suspension clamps are used to secure the messenger cable that supports the telephone cable suspended between the utility poles.

The applicable subheading for these products will be 7326.90.8586, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of iron or steel, other. The general rate of duty will be 2.9 percent ad valorem.

The eyebolts consist of an eyebolt body and a nut. The eyebolt is manufactured from mild steel and is hot dipped galvanized.

The applicable subheading for this product will be 7318.15.2090, Harmonized Tariff Schedule of the United States (HTS), which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel: threaded articles: other screws and bolts, whether or not with their nuts or washers: bolts and bolts and their nuts or washers entered or exported in the same shipment: having shanks or threads with a diameter of 6 mm or more: other: other. The general rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177).
