RE: The tariff classification of the Shoulder Pulley system from Taiwan.

Dear Ms. Gamiño:

In your letter dated July 1, 2002, you requested a tariff classification ruling.

You are requesting the tariff classification on a product that is identified as a Shoulder Pulley, style number 240. The item is an over-the-door pulley system used in hospitals and clinics, as well as in home settings. It is a simple-to-use device that helps increase and maintain range of motion in all planes of shoulder motion. The device is composed of a nylon pulley, webbed fabric door strap, braided rope and custom molded handles. The correct classification is in Chapter 95 of the HTSUSA as other exercise equipment. You have not requested the return of your sample.

The applicable subheading for the Shoulder Pulley system, style number 240, will be 9506.91.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for “Articles and equipment for general physical exercise, gymnastics, athletics, other sports (including table-tennis) or outdoor games, not specified or included elsewhere in this chapterparts and accessories thereof: Other: Articles and equipment for general physical, gymnastics or athletics; parts and accessories thereofOther.” The rate of duty will be 4.6 % ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
