RE: The tariff classification of cartridges for sniper rifles from Russia.

Dear Mr. Kessler:

In your letter dated June 25, 2002, you requested a tariff classification ruling.

You are requesting the tariff classification on cartridges that will be used as ammunition in different types of sniper rifles. You have submitted a specification sheet for both the rifles and the cartridges. The cartridges are identified as 12.7 x 108 sniping cartridges. The correct classification will be in Chapter 93 of the HTSUSA as cartridges, containing a projectile, for rifles and pistols. You have not submitted a sample at this time.

The applicable subheading for the sniper rifle cartridges will be 9306.30.4020, Harmonized Tariff Schedule of the United States (HTS), which provides for “Bombs, grenades, torpedoes, mines, missiles and similar munitions of war and parts thereof; cartridges and other ammunition and projectiles and parts thereof, including shot and cartridge wads: Other cartridges and parts thereof: Cartridges and empty cartridge shellsCartridges containing a projectile: For rifles or pistols: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
