RE: The tariff classification of a Puzzle in an Egg, Super Egg Putty, Easter Slipper, 3 Jump Ropes, 3 Jack Sets, and a Bunny Dart Game from China.

Dear Mr. Shostak:

In your letter dated June 27, 2002, you requested a tariff classification ruling.

You submitted the following samples:

Item #6120310, Puzzle in an Egg, consists of an egg shaped plastic container that contains puzzle pieces inside. When fitted together, the completed puzzle depicts a rabbit carrying an egg. The item is intended for children 3 years of age and older.

Item #6120190, Super Egg Putty, consists of an egg shaped plastic container that contains toy putty inside. The item is intended for children 3 years of age and older.

Item #6120330, Easter Slipper, consists of a blue colored rectangular shaped gel that is intended as a slippery, squishy toy for children 3 years of age and older to squeeze in their hands.

Item #6120130, 3 Jump Ropes, 3 Jack Sets, consists of three colored toy jump ropes and three jack sets (plastic jacks and rubber balls) packaged together for children 3 years of age and older. Although packaged together, the jump ropes and jack sets are not sets for Customs’ purposes and will be classified separately in their own appropriate headings.

Item #6120370, Bunny Dart Game, is a game that consists of a circular fabric material dartboard, two plastic darts, and two plastic balls. The dartboard depicts a rabbit and various circles with point totals inside. The two darts and the two balls have strips of hook and loop fastener material glued to them to facilitate adherence to the board.

The applicable subheading for Item #6120310, Puzzle in an Egg, will be 9503.60.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for Puzzles and parts and accessories thereof. The rate of duty will be free.

The applicable subheading for Item #6120190, Super Egg Putty, Item #6120330, Easter Slipper, and the 3 Jump Ropes, of Item #6120130 will be 9503.90.0080, HTS, which provides for Other toys; reduced-size ("scale") models and similar recreational models, working or not; puzzles of all kinds; parts and accessories thereof: Other: Other. The rate of duty will be free.

The applicable subheading for Item #6120370, Bunny Dart Game, will be 9504.90.6000, HTS, which provides for “Other: Chess, checkers, parchisi, backgammon, darts and other games played on boards of a special design, all the foregoing games and parts thereof (including their boards); mah-jong and dominoes; any of the foregoing games in combination with each other, or with other games, packaged together as a unit in immediate containers...poker chips and dice.” The rate of duty will be free.

The applicable subheading for the 3 Jack Sets of Item #6120130 will be 9504.90.9080, HTS, which provides for “Articles for arcade, table or parlor games, including pinball machines, bagatelle, billiards and special tables for casino games; automatic bowling alley equipment; parts and accessories thereof: Other: OtherOther.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
