RE: The tariff classification of accessories for the “Fiber Optic Gazebo”, # PP246793, from China.

Dear Ms. Wierbicki:

In your letter dated June 24, 2002, you requested a tariff classification ruling, on behalf of Avon products, Inc., your client.

You are requesting the tariff classification on merchandise that is comprised of separately sold accessories for a “Fiber Optic Gazebo” (# PP239337). The accessories for the gazebo are designated as # PP246793. The accessories range in size from approximately two to three inches in height. The accessories consist of the following: miniature figurines of Christmas carolers, two miniature fir trees covered with artificial snow, as well as a bag of artificial snow for sprinkling over the items once they are arranged as part of a festive Christmas holiday display. The articles are properly classified in Chapter 95 of the HTSUSA as Christmas ornaments. The samples will be returned, as requested by your office.

The applicable subheading for the accessories for the “Fiber Optic Gazebo”, # PP246793, will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Festive, carnival or other entertainment articlesparts and accessories thereof: Articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
