RE: The tariff classification of “Poodle Necklace Giftset” from China.

Dear Mr. Shapiro:

In your letter dated June 21, 2002, on behalf of Avon Products, Inc., you requested a tariff classification ruling.

The submitted sample, “Poodle Necklace Giftset” PP 252556, is a young girl’s poodle shaped necklace imported, sold and packaged with a small carrying case. The necklace is comprised of a poodle shaped silvertone base metal pendant on a silvertone brass chain. The chain measures approximately 15 inches and features a lobster clasp closure. The pendant measures ½ inch high, is shaped in the form of a poodle “decorated” with rhinestones as pom-poms, and will be suspended from the necklace. The “carrying case” is a small zippered purse made up to simulate a carrying case. It is wholly of man-made fiber textile materials and is unlined. The purse is of a kind similar to those normally carried in the pocket or in a handbag. The poodle necklace will be carded on a foam pad, which will be placed inside the carrying case.

Your sample is being returned as requested.

The applicable subheading for the necklace will be 7117.19.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for imitation jewelry: of base metal, whether or not plated with precious metal: other: other: other. The rate of duty will be 11% ad valorem.

The applicable subheading for the carrying case will be 4202.32.9550, HTS, which provides for articles of a kind normally carried in the pocket or in the handbag: with outer surface of sheeting of plastic or of textile materials: with outer surface of textile materials: other: other: of man-made fibers.” The rate of duty will be 18.1% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
