RE: The tariff classification of an “Automatic Card Shuffler” from China.

Dear Ms. Wierbicki:

In your letter dated July 11, 2002, you requested a tariff classification ruling, on behalf of Avon Products, Inc., your client.

You are requesting the tariff classification on an item designated as # PP TBD, “Automatic Card Shuffler”. The merchandise is essentially a battery-operated card shuffler. The article is comprised of a plastic housing and two shelf-like sections on either side of a central, domed compartment. When the deck of playing cards is placed onto the shelves and the button on the housing is depressed, the motor forces the two separate stacks of cards over rollers, mixing them together as they land into the central compartment. The card shuffler is properly classified in Chapter 95 of the HTSUSA as other accessories for games. The sample will be returned, as requested.

The applicable subheading for the “Automatic Card Shuffler”, # PP TBD, will be 9504.90.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Articles for arcade, table or parlor games, including pinball machines, bagatelle, billiards and special tables for casino games; automatic bowling alley equipment; parts and accessories thereof: OtherOther.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
