RE: The tariff classification of a “Sport Morph”, a binding for water skis or water boards, from Thailand.

Dear Ms. Murray:

In your letter dated June 27, 2002, you requested a tariff classification ruling, on behalf of Earth and Ocean Sports, Inc., your client.

You are requesting the tariff classification on a product that is described as a “Sport Morph” a binding used when water skiing on either skis or water boards. The binding is comprised of foam and rubber and attaches to the foot. The binding is connected to a circular metal plate that is covered with foam on the bottom. The “Sport Morph” is attached to the skis/boards by screws. The correct classification for the “Sport Morph” will be in Chapter 95 of the HTSUSA as parts and accessories for other water-sport equipment. The sample will be returned, as requested.

The applicable subheading for the “Sport Morph” will be 9506.29.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for “Articles and equipment for general physical exercise, gymnastics, athletics, other sports...or outdoor games...parts and accessories thereof: Water skis, surf boards, sailboards and other water-sport equipment; parts and accessories thereof: Other: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
