RE: The tariff classification of a satellite television antenna.

Dear Mr. Pilon:

In your letter dated June 27, 2002, on behalf of your client Channel Master LLC, you requested a tariff classification ruling.

The item in question is denoted as an antenna for direct satellite television reception systems. It is designed and intended for exclusive use with direct satellite commercial television systems. It is a “receive only” antenna that plugs directly into the set top box used to select individual satellite channels for viewing on the consumer’s television set. The particular country of origin has not yet been determined.

The applicable subheading for the satellite television antenna (receive only) will be 8529.90.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts suitable for use solely or principally with the apparatus of headings 8525 to 8528: Antennas and antenna reflectors of all kinds; parts suitable for use therewith; Television Antennas: Receiving only. The general rate of duty will be 1.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
