RE: The tariff classification of Hydration Systems, Carrying Bags, from China

Dear Mr. Spraitzer:

In your letter dated June 25, 2002 you requested a tariff classification ruling. The request is on behalf of Asics Tiger Corporation.

You have submitted samples of styles RN300, “Eagle Trail Backpack” and RN302, “Eagle Trail Fanny Pack”. Both articles consist of an insulated bag specially designed to primarily contain a bladder with drink tube and valve.. The bladder is also known as a “reservoir”. In addition to the bladder, each bag has a small storage pouch and or pocket intended to contain a July 3, 2002small amount of other personal effects such as keys and some money . Style RN300 has two hook and loop fasteners within which a flashlight or bicycle pump may be inserted. Both bags are of a kind similar to the insulated traveling bags of heading 4202, Harmonized Tariff System of the United States, Annotated. (HTSUSA). The bags are not of a kind primarily designed and used to contain clothing and other personal effects. The chief use of each bag is a means of providing storage, protection, and portability, while permitting easy access, for the water. This ruling applies only to the samples now presented. Other backpacks and sport bags, whether or not insulated, primarily designed and used to contain clothing or other personal effects may be classified within an other subheading of the HTSUSA. The exterior surface of each bag is wholly of a man-made fiber textile material. This office will retain the samples.

The applicable subheading for styles RN 300 and RN 302, Hydration Packs, will be 4202.92.0507, Harmonized Tariff Schedule of the United States (HTS), which provides, in part, for insulated food or beverage bags, with outer surface of textile materials, of man-made fibers. The rate of duty will be 7 per cent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
