RE: The tariff classification of a Disney Glamour Case and two Disney Beauty Sets from China.

Dear Mr. Greenberg:

In your letter dated June 4, 2002, you requested a tariff classification ruling.

You submitted the following photographs:

Item #65388, Disney Glamour Case, consists of a necklace, rings, earrings, fake nail polish, and lipstick packaged together in a plastic hinged carrying case decorated with Disney Characters. The glamour accessories are packaged on several plastic packing trays, with recessed compartments, inside the case. All of the accessories are color coordinated and designed to work together for play use for a child to role-play as a glamorous lady.

Item #65435, Disney Beauty Set, consists of a handbag, a mirror, a comb, a hairbrush, sunglasses with case, fake lipstick, fake eye shadow, and earrings packaged inside a window display box. The handbag, mirror and brush are decorated with Disney characters. All of the accessories are color coordinated and designed to work together for play use for a child to role-play as a glamorous lady.

Item #65355, Disney Beauty Set, consists of fake nail polish, a mirror, a toy curling iron, a nail brush, a soap dish, fake lipstick, a toy hair dryer with diffuser, fake eye shadow, lotion, and cream. All of the accessories are color coordinated and designed to work together for play use for a child to role-play as a glamorous lady.

The applicable subheading for Item #65388, Disney Glamour Case, Item #65435, Disney Beauty Set, and Item #65355, Disney Beauty Set, will be 9503.70.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Other toys, put up in sets or outfits, and parts and accessories thereof. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
