RE: The tariff classification of electric light sets from China.

Dear Mr. Boschetto:

In your letter received in this office on June 19, 2002, you requested a tariff classification ruling.

The samples submitted are light sets that consist of two electrical green wire harnesses with each measuring several yards in length. Each harness contains plastic sockets incorporating LED’s with miniature plastic decorative light covers. One light set has 35 lights with a blue cover, while the other set has 40 lights with a clear cover. It is stated that these light sets will be used to decorate various areas both inside and outside the home during the Christmas season.

The applicable subheading for these electric light sets will be 9405.40.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other electric lamps and lighting fittings, other than of base metal. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
