RE: The tariff classification of “A Spinning Snowflake Snowman”, item # 187063, from China.

Dear Ms. Santos:

In your letter dated May 31, 2002, you requested a tariff classification ruling.

You are requesting the tariff classification on an animated display figure identified as item # 187063, “A Spinning Snowflake Snowman”. The item is a snowman that when activated will dance, tip his hat and spin the lighted snowflakes that he is holding. The decorative snowman also plays two songs: “Snow Miser” and “Let it Snow”. The product is an article that is appropriate for display during the Christmas season. The sample will be returned, as requested.

The applicable subheading for the “Spinning Snowflake Snowman” will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Festive, carnival or other entertainment articlesparts and accessories thereof: Articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
