RE: The tariff classification of a sleeve wrap, thermos, poncho, blanket and travel kit from China, Taiwan and/or Indonesia.

Dear Ms. Miller:

In your letter dated May 21, 2002 you requested a classification ruling. As requested, the samples will be returned to you.

The submitted samples are Style #s AC0111 Tee Sleeve Wraps, AC0112 NIKE Thermal Mug, AC0115 Pocket Poncho, AC0116 Travel Fleece and AC0117 Personal Travel Kit with Bottles.

Style # AC0111 Tee Sleeve Wraps are constructed of woven nylon fabric with hook and loop closures. They convert short sleeve tee shirts to sleeveless.

Style # AC0112 NIKE Thermal Mug is without handles, has dual-walled construction, and is made of polycarbonate with rubber side grips.

Style # AC0115 Pocket Poncho is constructed of EVA plastic and is a one-size-fits-most waterproof poncho with hood and drawstring closure.

Style # AC0116 Travel Fleece is constructed of 100% knit polyester thermal fleece fabric. The blanket measures approximately 40 inches x 60 inches and folds into a backpack-style bag.

Style # AC0117 Personal Travel Kit with Bottles is an organizer made of 100% polyester fabric with a nylon lining. It is a durable organizer for grooming products. It features a large hook to hang for easy access, a large interior mesh zip pocket to allow wet items to dry and plastic travel-size containers for toiletries.

The applicable subheading for the Style # AC0111 Tee Sleeve Wraps will be 6217.10.9530, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: Accessories: Other: Other, Of man-made fibers.” The duty rate will be 14.8% ad valorem. The textile category designation is 659.

The applicable subheading for the Style # AC0112 NIKE Thermal Mug will be 3924.10.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Tableware, kitchenware, other household articles and toilet articles, of plastics: Tableware and kitchenware, Other.” The duty rate will be 3.4% ad valorem.

The applicable subheading for the Style # AC0115 Pocket Poncho will be 3926.20.9050, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other articles of plastics and articles of other materials of headings 3901 to 3914: Articles of apparel and clothing accessories (including gloves): Other: Other, Other.” The duty rate will be 5% ad valorem.

The applicable subheading for the Style # AC0116 Travel Fleece will be 6301.40.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for “Blankets and traveling rugs: Blankets (other than electric blankets) and traveling rugs, of synthetic fibers, Other.” The duty rate will be 9.4% ad valorem. The textile category designation is 666.

The applicable subheading for the Style # AC0117 Personal Travel Kit with Bottles will be 9605.00.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Travel sets for personal toilet, sewing or shoe or clothes cleaning (other than manicure and pedicure sets of heading 8214.” The duty rate will be 8.1% ad valorem.

China, Taiwan and Indonesia are members of the World Trade Organization (WTO), and the Style # AC0116 Travel Fleece is not subject to quota restrictions or the requirement of a visa. However, based upon international textile trade agreements Style # AC0111 Tee Sleeve Wraps is subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
