RE: The tariff classification of a printed plastic label or sign from Canada.

Dear Mr. Pentland:

In your letter dated May 8, 2002, you requested a tariff classification ruling on behalf of your client, Ad-Print (Coquitlam, BC, Canada).

A sample identified as a “decal” was submitted for our examination. It is a 3½” x 5½” sheet of clear, flexible vinyl film with a release-paper backing. It is printed with a picture of a bottle of a certain ale, adjacent to which are a logo and a few words concerning the ale. You indicate that the plastic is meant to be peeled off its backing and applied to a beer cooler door. The plastic does not have any adhesives on it and is designed to adhere to a surface by static cling.

The applicable subheading for the static-cling “decal” will be 4911.99.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other (non-enumerated) printed matter. The general rate of duty will be 1%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Carl Abramowitz at 646-733-3037.

Sincerely,

Robert B. Swierupski
