RE: The tariff classification of two men’s jackets from China or Sri Lanka

Dear Mr. Thompson:

In your letter dated May 24, 2002, on behalf of Richlu Sportswear, you requested a classification ruling.

Two samples were submitted as follows: Style number I68211121 is a man’s jacket constructed of a shell composed of a plaid design 100% cotton flannel fabric. The jacket is lined in the body with a knit brushed 100% polyester fleece fabric and has a hood composed of the same fabric.

The jacket features an integral hood with a drawcord tightening, a fold-down pointed collar and a full front opening that is secured by a one-button closure at the neck and five snap closures along the front placket. The jacket has two chest pockets with flaps secured by a one-snap closure, long sleeves with adjustable snap closures on the cuffs, two side-seam pockets at the waist and a shirt-tail hemmed bottom.

Style number I64311121 is a man’s jacket constructed of a shell composed of a woven duck cloth 100% cotton fabric. The jacket is lined with a woven 100% nylon fabric that is quilted in a diamond pattern to a nonwoven polyester batting insulation. In your letter you indicate that the jacket’s shell fabric weighs 10 ounces per square yard. The jacket has a fold-down pointed collar and a full front opening that is secured by a one-button closure at the neck and five snaps along the front placket. The jacket features two chest pockets with flaps that are secured by a one-snap closure, long vented sleeves with adjustable snap closures on the cuffs and a shirt-tail hemmed bottom.

The samples are being returned to you as you have requested.

The applicable subheading for the each jacket will be 6201.92.2051, Harmonized Tariff Schedule of the United States (HTS), which provides for other men’s anoraks, windbreakers and similar articles: of cotton. The duty rate will be 9.5 percent ad valorem.

Each jacket falls within textile category designation 334. Based upon international textile trade agreements products of China or Sri Lanka are presently subject to quota restraints and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
