RE: The tariff classification of three men’s knit garments and a blanket from China.

Dear Mr. Unger:

In your letter, which was received by this office on June 3, 2002, you requested a tariff classification ruling on behalf of Top Threads Sportswear (Ackerly Ind., d/b/a Top Threads). As requested, your samples will be returned.

Item # 99969 is a men’s vest constructed from 100 percent polyester, finely knit fabric that is napped on the inside and outside surfaces. Item # 99969 features oversized armholes; a stand-up collar; a full front opening with a zipper closure; zippered pockets below the waist; and a tunnel elastic bottom.

Item # 99965 is a men’s jacket constructed from 100 percent polyester, finely knit fabric that is napped on the inside and outside surfaces. Item # 99965 features a stand-up collar; a full front opening with a zippered closure; long sleeves with tunnel elastic cuffs; zippered pockets below the waist; and a tunnel elastic bottom.

Item # 99948 is a men’s pullover garment constructed from 100 percent polyester, finely knit fabric that is napped on the inside and outside surfaces. Item # 99948 features a stand-up collar; a partial front opening with a zippered closure; long sleeves with tunnel elastic cuffs; side seam pockets below the waist; and a tunnel elastic bottom.

Item # 99981 is a traveling blanket with a carry strap. The blanket is constructed from 100 percent polyester, finely knit fabric that is napped on the inside and outside surfaces.

The applicable subheading for Item # 99969 will be 6110.30.3030, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: vests, other than sweater vests: men’s or boys’. The rate of duty will be 32.4 per cent ad valorem.

The applicable subheading for Item # 99965 will be 6101.30.2010, Harmonized Tariff Schedule of the United States, (HTS), which provides for: men’s or boys’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers, and similar articles, knitted or crocheted: other than those of heading 6103: of man-made fibers: other: other: men’s. The rate of duty will be 28.6 percent ad valorem.

The applicable subheading for Item # 99948 will be 6110.30.3050, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other; other: men’s or boys’. The rate of duty will be 32.4 per cent ad valorem.

The applicable subheading for Item # 99981 will be 6301.40.0020, Harmonized Tariff Schedule of the United States, (HTS), which provides for: blankets (other than electric blankets) and traveling rugs, of synthetic fibers: other. The rate of duty will be 9.4 per cent ad valorem.

Item # 99969 falls within textile category designation 659. Item # 99965 falls within textile category designation 634. Item # 99948 falls within textile category designation 638. Item # 99981 falls within textile category designation 666. Based upon international textile trade agreements, products of China in textile categories 634, 659 and 638 are subject to visa requirements and quota restraints. Products of China in textile category 666 are not presently subject to visa requirements or quota restraints.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
