RE: The tariff classification of tool steel bar from Brazil and Taiwan.

Dear Ms. Taeger:

In your letter dated May 2, 2002 on behalf of Timken Latrobe Steel Distribution, you requested a tariff classification ruling. A representative sample of the product to be imported was submitted with your request.

The products to be imported are alloy tool steel round bars. The bars range in size from 3 inches to 9 inches. These bars are hot forged and then peeled to remove surface imperfections and to size the bars to precise measurement specifications. Representative mill certificates from both the Brazilian and the Taiwanese mills were submitted. AISI Type H13 tool steel round forged-spheroidized-peeled 4 ¼ inch bars are described on the Brazilian mill certificate. Specification A 681 is shown on this mill certificate. AISI Type D2 tool steel round hot-forged-spheroidized-peeled 4 ¼ inch bars are described on the Taiwanese mill certificate. Specification A 681 is also shown on this mill certificate. ASTM Specification A 681 is the Standard Specification for Tool Steels Alloy and covers both hot and cold finished bars.

The applicable subheading for the forged and peeled alloy tool steel bars will be 7228.50.1060, Harmonized Tariff Schedule of the United States (HTS), which provides for other bars and rods of other alloy steel, other bars and rods, not further worked than cold-formed or cold-finished, of tool steel (other than high-speed steel), other, with a maximum cross-sectional dimension of 18 mm or more, of round or rectangular cross section with surfaces ground, milled or polished. The rate of duty will be 2.1 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
