RE: The tariff classification of “Child’s Sleeping Bag Chair” from China.

Dear Mr. Wilson:

In your letter dated May 7, 2002 you requested a tariff classification ruling. The sample is being returned as requested.

The sample submitted is a “Child’s Sleeping Bag Chair,” style number 56155. It is made of pile textile fabric designed in the shape of a chair resembling a teddy bear. The front of the seat area features a zippered compartment which contains an attached sleeping bag for children ages 2 to 4.

The applicable subheading for the “Child’s Sleeping Bag Chair” will be 9404.30.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for sleeping bags. The rate of duty will be 9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
