RE: The tariff classification of a four-piece woman’s knit pajama set from Turkey.

Dear Ms. Bies:

In your letter dated May 6, 2002, you requested a classification ruling for a four-piece women’s knit pajama set. The garments are being returned as you requested.

Style A106686 is constructed from 100 percent cotton lightweight knit fabric. The four piece set contains two pajama tops and two pajama bottoms. All four garments will be imported and sold as a unit. The tank top styled pajama top has 1-¾ inch shoulder straps, a U-shaped neckline in front and back, rib knit capping finishing the neckline and armhole openings, and a plain, hemmed bottom. The cardigan styled pajama top has a V-shaped neckline; a full front opening with snap closure; ¾ length sleeves; one breast pocket; rib knit capping finishing the neckline, placket, pocket top and sleeves, and a hemmed bottom with three inch side slits. The short length pajama bottoms have an elasticized waistband and hemmed leg openings with 2-½ inch side slits. The capri length pajama bottoms have an elasticized waistband with a drawstring, one front patch pocket, and hemmed leg openings with 2-½ inch side slits.

Based on the appearance of the garments, and the manner in which they are merchandised, these garments are considered sleepwear of heading 6108. Each unit of style A106686 contains two pair of pajamas.

The applicable subheading each pair of pajamas within style A106686 will be 6108.31.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for Women’spajamas, knitted or crocheted: Of cotton. The duty rate will be 8.6 percent ad valorem.

Each pair of pajamas within style A106686 falls within textile category designation 351. Based upon international textile trade agreements products of Turkey are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
