RE: The tariff classification of electrical cables and other devices from China and Thailand

Dear Ms. Bartlett:

In your letter dated April 1, 2002 you requested a tariff classification ruling.

As indicated by the submitted samples, there are five items in question. Item SKU # K03-00001 is described as a Xbox High Definition AV Pack and item SKU # K05-00001 is described as an Advanced AV Pack. Item SKU # K06-00001 is an Xbox Standard AV Cable and item SKU # K08-00005 is an Xbox System Link Cable. Item SKU #K07-00001 is described as an RF Adapter.

The applicable subheading for the Xbox Standard AV Cable, item SKU K06-00001, will be 8544.51.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for other electric conductors, for a voltage exceeding 80 V but not exceeding 1,000 V: Fitted with connectors: Other: Other. The duty rate will be 2.6 percent ad valorem. The applicable subheading for the Xbox System Link Cable, item SKU # K08-00005, will be 8544.51.4000, HTS, which provides for other electric conductors, for a voltage exceeding 80 V but not exceeding 1,000 V: Fitted with connectors: Fitted with modular telephone connectors. The duty rate will be Free.

Your inquiry does not provide enough information for us to give a classification ruling on the AV Packs and the RF Adapter. Your request for a classification ruling should include more specific information as to the function of each of these items and a detailed explanation as to how those functions are accomplished. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
