RE: The tariff classification of 35mm camera from China

Dear Mr. Shapiro:

In your letter dated April 8, 2002, on behalf of Avon Products, Inc., you requested a tariff classification ruling. A representative sample of the Motion Camera was submitted with the ruling request.

The submitted item number PP 239099 is identified as the Motion Camera. The submitted Motion Camera is a fixed focus 35mm camera without a flash unit. The camera features a wrist strap that is permanently attached to the plastic camera body. The camera has four built-in lenses that take four sequential photos within each frame of film. The camera uses 35mm film that contains 12, 24 or 36 exposures. The film is loaded by the consumer into the back of the camera. The film compartment is accessed by a hinged back cover. Pictures are taken by pressing a shutter release button located on the top of the camera and subsequently advancing each frame via a film winding wheel. Once each frame of film has been taken, a film rewind crank located on the top of the camera enables the film to be re-rolled into its original container and removed by the consumer. You have indicated that Avon Products, Inc. contemplates importing the Motion Camera from China. You have stated that the camera will be imported in a retail container marked with the country of origin.

Your sample is being returned as requested.

The applicable subheading for the camera will be 9006.53.0070, Harmonized Tariff Schedule of the United States (HTS), which provides for photographic (other than cinematographic) cameras; other cameras; other, for roll film of a width of 35 mm; other; other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
