RE: The tariff classification of the Diopter Mit Kortraeger sight-system for rifles from Switzerland.

Dear Mr. Regan:

In your letter dated March 22, 2002, you requested a tariff classification ruling.

You are requesting the tariff classification on an item that is identified as the Diopter Mit Kortraeger sight-system that attaches to a rifle. The sight-system does not contain any optical elements, for example, lenses, prisms or mirrors. The sight does not provide magnification to the user, i.e.: it is not a telescopic sight. The sight will be classified in Chapter 93 of the HTSUSA as an accessory to rifles. There are no import restrictions by U. S. Customs on the Diopter Mit Kortraeger sight system for rifles.

The applicable subheading for the Diopter Mit Kortraeger sight-system for rifles will be 9305.29.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Parts and accessories of articles of headings 9301 to 9304: Other: Of rifles: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
