RE: The tariff classification of women’s woven garments from China

Dear Mr. Holmes:

In your letter dated March 28, 2002, you requested a classification ruling. The samples submitted with your request will be returned to you under separate cover.

Style 6748 is a women’s blouse that features long sleeves with button cuffs, a pointed collar, a full front opening secured by five buttons and a hemmed bottom. The garment is made from a ground fabric that is 100 percent silk and a pile surface of 100 percent rayon. You state that the overall fiber content, by weight, is 70 percent silk and 30 percent rayon woven fabric. Section XI subheading note 2(B) states that:

In the case of textile products consisting of a ground fabric and a pile or looped surface no account shall be taken of the ground fabric;

Accordingly, the classification of this garment will be based on the pile surface, that is, the rayon portion of the fiber content.

Style 7609 is a women’s shirt made from 61% polyester, 35% rayon and 4% spandex woven fabric. The garment features long hemmed sleeves, a pointed collar, a full front zippered closure, side pockets and a banded bottom.

The applicable subheading for style 6748 will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of man-made fibers, other. The duty rate will be 27.2 percent ad valorem.

The applicable subheading for style 7609 will be 6211.43.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments: of man-made fibers, blouses, shirtsexcluded from heading 6206. The duty rate will be 16.2 percent ad valorem.

Styles 6748 and 7609 fall within textile category designation 641. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
