RE: The tariff classification of a pair of women’s pajamas from Hong Kong.

Dear Mr. Maher:

In your letter dated March 12, 2002, on behalf of your client Delta-Galil USA, you requested a tariff classification ruling.

The submitted sample, Style #X1D-317-303, is a women’s pajama set consisting of shorts and a top constructed from 100% nylon knit fabric. The top of Style #X1D-317-303, features adjustable spaghetti straps, a v-neckline with lace trim, a straight back, and a hemmed bottom. The pull-on shorts feature an elasticized waistband with a satin bow stitched to the front, and lettuce edging at the leg openings.

Based on the appearance of the style, it is considered sleepwear and classified in heading 6108.

We are returning your sample as you requested.

The applicable subheading for Style #XID-317-303, will be 6108.32.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women's knit pajamas of man-made fibers, women’s. The rate of duty will be 16.2% ad valorem.

Style # XID-317-303, falls within textile category designation 651. Based upon international textile trade agreements this category, from Hong Kong is subject to visa requirements, and quota restraints. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available at the Customs Web Site at WWW.CUSTOMS.GOV.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
