RE: The tariff classification of coated wrapping paper from China

Dear Mr. Collini:

In your letter dated March 4, 2002, on behalf of your client, The Lindy Bowman Co., Inc., you requested a tariff classification ruling. Samples were submitted, which were gift boxes with wrapping paper packaged with them, and, wrapping paper, to be imported alone.

The gift boxes with wrapping paper packaged with them, were the subject of ruling letter NY H88999, dated March 11, 2002. The instant ruling will classify the wrapping paper, when imported alone.

The sample was wrapping paper in rectangular sheets, of a size greater than 36 cm x 15 cm. They were consumed in laboratory analysis. The laboratory reports that they are printed decorative white paper, coated with an inorganic material on both sides, weighing 84.7 grams per square meter, colored throughout the mass, composed of chemical bleached kraft pulp fibers.

The applicable subheading for the wrapping paper described will be 4810.31.1060, Harmonized Tariff Schedule of the United States (HTS), which provides for: Paper and paperboard, coated on one or both sides with kaolin (China clay) or other inorganic substances, with or without a binder, and with no other coating, whether or not surface-colored, surface-decorated or printed, in rolls or rectangular sheets, of any size: Kraft paper and paperboard, other than that of a kind used for writing, printing, or other graphic purposes: Bleached uniformly throughout the mass and of which more than 95 percent by weight of the total fiber content consists of wood fibers obtained by a chemical process and weighing 150 g/m2 or less: In strips or rolls of a width exceeding 15 cm or in rectangular (including square) sheets with one side exceeding 36 cm and the other side exceeding 15 cm in the unfolded state: Other (than folding carton stock, or base stock for trays, dishes cups and the like).The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
