RE: The tariff classification of two glass articles, a metal article and a zinc article from China

Dear Ms. Richardson:

In your letter dated February 1, 2002, you requested a tariff classification ruling. Representative samples were submitted with your ruling request.

You indicated in your letter that you wish to import the following articles: a 9.5” square glass tray with metal lace-like trim, a 4” glass bottle with metal lace-like trim, a 3” x 5” metal lace-like photo frame and a 2” square zinc lace-like trinket box with glass. The unit values are $2.87, $0.74, $1.98 and $1.26, respectively.

You indicated in your letter that each item will be imported packaged together and put up for retail sale as a vanity set. For classification purposes the aforementioned items are not considered to be a set. These items are not put up to meet one particular need or carry out a specific activity. Thus, the goods do not comprise a set for purposes of GRI 3(b). Each item will be classified individually.

The applicable subheading for the glass tray with metal trim and the glass bottle with metal trim will be 7013.99.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes: other glassware: other: other: valued over $0.30 but not over $3.00. The rate of duty will be 30 percent ad valorem.

The applicable subheading for the metal photo frame will be 8306.30.0000, HTS, which provides for photograph, picture and similar frames, of base metal. The rate of duty will be 2.7 percent ad valorem. The applicable subheading for the zinc trinket box will be 7907.00.1000, HTS, which provides for other articles of zinc, articles of a type used for household, table or kitchen. The rate of duty will be 3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
