RE: The tariff classification of the Altura GT-602/OM Lottery Ticket Machine from various countries.

Dear Mr. Kenneally:

In your letter dated January 7, 2002, on behalf of your client GTECH Corporation you requested a tariff classification ruling.

The merchandise under consideration is the Altura GT-602/OM Lottery Ticket Machine. This machine measures approximately 13” in width by 15” in depth and is 15” high, and is constructed of injection molded plastic over a sheet metal frame. The Altura GT-602/OM is described in your literature as an integrated point-of sale lottery terminal. The terminal features an adjustable color Liquid Crystal Display (LCD) touch screen, Contact Image Scanner (CIS) reader, high-performance microprocessor, 64MB of Dynamic Random Access Memory (DRAM) and 24MB of Flash memory. Advanced personal computer architecture supports multiple printers and third party products. An optional barcode reader can be ordered to provide instant ticket validation and control. The principal function of this machine appears to be ticket issuing.

Explanatory Notes to the HTS, Heading 8470 (D) (2) makes note to similar machines used for ticket issuing (e.g., cinema or railway tickets).

The applicable subheading for the Altura GT-602/OM Lottery Ticket Machine will be 8470.90.0090, Harmonized Tariff Schedule of the United States (HTS), which provides for “ticket-issuing machines and similar machines, incorporating a calculating device; cash registers: Other: Other.” The country of origin will determine the rate of duty at the time of import.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
