RE: The tariff classification of coin purses from the Philippines

Dear Mr. Pascual:

In your letter dated December 13, 2001 you requested a tariff classification ruling. The request is on behalf of Grand Cru International.

Samples of two coin purses with zipper closures have been submitted. They are not identified by style numbers. Sample #1 is made up of man-made textile materials which is wholly covered with strung glass beads. Sample #2 is wholly made up of man-made textile materials. The exterior surface is of nylon lace construction. The samples will be returned as requested.

The applicable subheading for Sample #1will be 7018.90.5000 Harmonized Tariff Schedule of the United States (HTS), which provides for glass beads and articles thereof other than imitation jewelry, other: other. The rate of duty will be 6.6% ad valorem for 2001 and 2002.

The applicable subheading for Sample #2 will be 4202.32.9550, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of a kind normally carried in the pocket or in the handbag, with outer surface of sheeting of plastic or of textile materials, other, other. The rate of duty will be 18.3% ad valorem for 2001 and 18.1% for 2002.

Articles classifiable under subheading 7018.90.5000 HTS, which are products of the Philippines are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on "CEBB" and then search for the term "GSP".

HTS 4202.32.9550 falls within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
