RE: The tariff classification of whole, white peppercorn and whole, black peppercorn from Malaysia.

Dear Mr. Chowdhury:

In your letter, dated December 7, 2001, you requested a tariff classification ruling.

The merchandise is described thus:

Sara Spice® brand “Sarawak Pepper” is comprised of retail packs of whole, white peppercorn. The product is available in 50 gram, 100 gram, 220 gram, and 250 gram plastic containers, 5 pound plastic bottles, and 25 kilogram plastic or paper sacks. Sara Spice ® brand “Lada Hitam (Bersih Asli) Black Pepper” is comprised of retail packs of whole, black peppercorn. The product is available in 50 gram, 100 gram, 220 gram, and 250 gram plastic containers, 5 pound plastic bottles, and 25 kilogram plastic or paper sacks.

The applicable subheading for whole, white peppercorn (item 1) will be 0904.11.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for pepper of the genus Piper; dried or crushed or ground fruits of the genus Capsicum (peppers) or of the genus Pimenta (e.g., allspice), pepper of the genus Piper, neither crushed nor ground, white. The rate of duty will be free. In 2002 the rate of duty will remain the same.

The applicable subheading for whole, black peppercorn (item 2) will be 0904.11.0020, HTS, which provides for pepper of the genus Piper; dried or crushed or ground fruits of the genus Capsicum (peppers) or of the genus Pimenta (e.g., allspice), pepper of the genus Piper, neither crushed nor ground, black. The rate of duty will be free. In 2002 the rate of duty will remain the same.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177).
