RE: The tariff classification of men’s and boys’ trousers from Hong Kong

Dear Ms. Huang:

In your letter dated December 10, 2001, you requested a classification ruling.

You submitted samples of men’s and boys trousers. There were no style numbers associated with either garment. The men’s trousers are made of 70% cotton and 30% nylon woven fabric. The garment features a front zippered fly, a buttoned waistband with five belt loops, two side pockets, two back pockets with flaps, a zippered side seam pocket at the thigh area, and lower pant legs which are detachable by means of zippers. There are also hook and loop fabric tabs at the bottom of the pant legs to adjust the leg opening and two hook and loop fabric tabs on the waistband which allow items to be affixed to these tabs. Attached to one of the tabs (but not permanently), is a key holder comprised of a metal split ring and a textile webbing which snaps shut to hold the ring. In a telephone conversation you stated that the key ring would be imported already affixed to the pants and sold in that condition. The boys’ pants are made of 100% cotton blue denim fabric. The garment features six belt loops through which a textile webbed camouflage belt is threaded, two front side pockets, a front carpenters pocket, two back pockets and a zippered front fly. You state that the belt is an integral part of the pants, intended to be imported already affixed to the pants and sold at retail as a unit. Your samples will be returned.

The applicable subheading for the men’s trousers will be 6203.42.4015, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’ trousers, bib and brace overalls, breeches and shorts, of cotton, other, other, trousers and breeches, men’s other.. The duty rate will be 16.9 percent ad valorem. In 2002, the duty rate will be 16.8 percent ad valorem.

The applicable subheading for the boys’ denim pants and belt will be 6203.42.4035, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’ trousers, bib and brace overalls, breeches and shorts, of cotton, other, other, trousers and breeches, boys’ other, other. The duty rate will be 16.9 percent ad valorem. In 2002, the duty rate will be 16.8 percent ad valorem.

The applicable subheading for the detachable keyring will be 7326.20.0050, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of iron or steel, articles of iron or steel wire, other. The duty rate will be 3.9 percent ad valorem. In 2002, the duty rate remains the same.

Both pairs of pants fall within textile category designation 347. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
