RE: The tariff classification of “Small Light Art” from China.

Dear Ms. Aldinger:

In your letter dated December 4, 2001, you requested a tariff classification ruling.

The sample that you submit Item #996181, “Small Light Art”, is an art set designed for children that consists of a plastic rectangular shaped Lite Art unit that measures approximately 4-1/4” in height x 9” in width x 12” in length, a plug-in cord, sixteen design sheets, colored pegs, crayons, and instructions. A light bulb (not included), 25-watts or less, is required to illuminate the colored pegs as they are inserted into a design sheet held secure by the plastic Lite Art unit. The intended use of this product is creative play, using the light pegs to enhance or create full color pictures, design sheets, or original images.

The applicable subheading for Item #996181, “Small Light Art”, will be 9503.90.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for other toys; reduced-size ("scale") models and similar recreational models, working or not; puzzles of all kinds; parts and accessories thereof: other: parts and accessories. The rate of duty will be free. The rate of duty will remain unchanged in the year 2002.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
