RE: The tariff classification of a tote bag, sandals, beach mat and a plastic hair clip from China.

Dear Ms. Liu:

In your letter dated August 14, 2001, you requested a tariff classification ruling.

The sample submitted, identified as item C50F0669, consists of a tote bag of clear polyvinyl chloride (PVC) sheeting. It is unlined and has double handles. Inside the tote bag is a pair of rubber sandals, a straw beach mat of sea grass with textile trim and a sewn-in pocket, and a plastic jaw hair clip. The samples submitted are described as a “set”. However, for classification purposes the items are not considered to be a set. Each item will be separately classified. Your samples are being returned as requested.

The applicable subheading for the tote bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of sheeting of plastic, other. The rate of duty will be 20 percent ad valorem.

The applicable subheading for the sandals will be 6402.20.00, HTS, which provides for footwear with outer soles and uppers of rubber or plastics with upper straps or thongs assembled to the sole by means of plugs (zoris). The rate of duty will be Free.

The applicable subheading for the beach mat will be 4602.10.8000, HTS, which provides for other (non-enumerated) articles of vegetable plaiting materials. The rate of duty will be 2.3 percent ad valorem.

The applicable subheading for the hair clip will be 9615.11.4000, HTS, which provides for combs, hair-slides and the like: of hard rubber or plastics: other: not set with imitation pearl or imitation gemstones. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
