RE: The tariff classification of a Pump Mounted Refueling Truck from Australia

Dear Mr. Gomez:

In your letter dated August 13, 2001 you requested a tariff classification ruling on behalf of your client Summit Global Logistics.

You submitted a picture and descriptive literature of a Pump Mounted Refueling Truck to be used at airports. A pump module is mounted to a commercial truck chassis. A PTO, which is fitted to the transmission of the vehicle, is used to provide power to enable jet fuel (JET-A) to be pumped into the aircraft. Some features of the vehicle are: The rear of the cab is modified to provide a firewall between the engine compartment and the aircraft fueling system, which prevents any jet fuel being spilled on a hot vehicle engine. The vehicle brakes are modified to ensure that the vehicle cannot be driven away with the refueling hose connected to the aircraft. An emergency override system is installed to the brake system, which permits the vehicle to drive away in case of a fire on the aircraft. The engine exhaust is relocated to the very forward most position of the cab, under the front bumper to ensure any hot surface is as far as possible from the jet fuel as possible. The vehicle operates at a speed of 10 MPH at airport locations.

The applicable subheading for the Pump Mounted Refueling Truck will be 8705.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Special purpose motor vehicles, other than those principally designed for the transport of persons or goods (for example, wreckers, mobile cranes, fire fighting vehicles, concrete mixers, road sweepers, spraying vehicles, mobile workshops, mobile radiological units): Other. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
