RE: The tariff classification of 35mm camera with fitted case from China

Dear Mr. Epstein:

In your letter dated August 10, 2001, on behalf of Avon Products, Inc., you requested a tariff classification ruling. A representative sample of the 35mm camera with fitted case was furnished with the ruling request.

The submitted item number PP 228484 is identified in your letter as “Destiny’s Child” Mini Bag/Camera. This item is described in your letter as a manually operated plastic 35mm fixed-focus camera with a textile carrying strap. The camera is without a built-in flash unit. You have indicated that the camera will be imported and sold with a specially fitted carrying case with a textile outer surface composed of 54 percent ramie and 46 percent polyester. The camera case features two exterior sewn on plastic patches and two zippered compartments. The patch sewn onto the top front of the case features the name of the musical group “Destiny’s Child”. The patch sewn onto the bottom front of the case features a photograph of “Destiny’s Child”. You have stated that the larger compartment is specially sized to hold the 35mm camera, and the smaller compartment may be used to carry a roll of film. The case also features a webbed polypropylene adjustable carrying strap. You have indicated that Avon Products, Inc. contemplates importing “Destiny’s Child” Mini Bag/Camera from China.

Your sample is being returned as requested.

The applicable subheading for the 35mm camera with fitted case will be 9006.53.0070, Harmonized Tariff Schedule of the United States (HTS), which provides for photographic (other than cinematographic) cameras; other cameras; other, for roll film of a width of 35mm; other; other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
