RE: The tariff classification of copper-plated steel from Korea.

Dear Mr. Wackerman:

In your letter dated July 16, 2001 on behalf of Dongyang America Corp. and SK Global America, Inc., you requested a tariff classification ruling. Representative samples were submitted with your request.

The product to be imported is cold-rolled nonalloy flat-rolled steel that has been electrolytically plated with copper. This copper-plated steel, known as “Copper-Lite”, will ultimately be used for double-walled steel pipes, brake pipes, components for refrigerator condensers and transistors and electric and electronic components.

The applicable subheading for the copper-plated flat-rolled steel that measures 600 mm or more in width will be 7210.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for flat-rolled products of iron or nonalloy steel, of a width of 600 mm or more, clad, plated or coated, other, other, electrolytically coated or plated with base metal. The rate of duty will be 1.7 percent ad valorem.

The applicable subheading for the copper-plated flat-rolled steel that measures less than 600 mm in width will be 7212.50.0000, HTS, which provides for flat-rolled products of iron or nonalloy steel, of a width of less than 600 mm, clad, plated or coated, otherwise plated or coated. The rate of duty will be 2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

You have asked whether this product is subject to antidumping duties or countervailing duties.
