RE: The tariff classification of four narrow knit fabric trimmings from China.

Dear Mr. Kenneally:

In your letter dated July 16, 2001, on behalf of your client Wm. E. Wright Limited Partnership, you requested a classification ruling.

Four samples of knit trimming fabric accompanied your request for a ruling. The first, designated as item #604661, is a warp knit trimming fabric measuring 0.5 inches in width. It is composed of 67% metalized yarns and 33% viscose rayon. It features a weft insertion of two different metalized yarns characterized by metalized strip gimped around a textile yarn support. Item #6052385 is a warp knit trimming fabric measuring 0.375 inches in width. It is composed of 76% metalized yarn , 17% viscose rayon and 10% polyester. It features an inserted yarn to which plastic spangles have been sewn. This yarn is incorporated into the trimming during the weaving process.

Item #6055512 is a warp knit trimming measuring 0.5 inches in width. It is composed of 68% metalized yarn, 22% viscose rayon and 10% nylon. It is characterized by a weft insertion of a knit yarn. Item #60628 is a warp knit trimming fabric measuring approximately 0.5 inches in width. It is composed of 54% acrylic, 22% viscose rayon and 24% metalized yarn. It is characterized by a weft insertion of a multifilament yarn along with a weft insertion of a metalized knit yarn.

The applicable subheading for the three warp knit fabrics designated as item numbers 604661, 6052385 and 6055512 will be 6002.20.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for other knitted or crocheted fabrics, other, of a width not exceeding 30 centimeters, other, other. The duty rate will be 6.9 percent ad valorem.

The applicable subheading for the warp knit fabric designated as item number 606228 will be 6002.20.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for other knitted or crocheted fabrics, other, of a width not exceeding 30 centimeters, other, of man-made fibers. The duty rate will be 7.9 percent ad valorem.

The three warp knit fabrics designated as item numbers 604661, 6052385 and 6055512 fall within textile category designation 899. Based upon international textile trade agreements products of China are subject visa requirements.

The warp knit fabric designated as item number 606228 falls within textile category designation 222. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
