RE: The tariff classification of embroidered fabric from India

Dear Ms. Bosseckert:

In your letter dated July 23, 2001, on behalf of your client Hanky Panky Ltd., you requested a tariff classification ruling. The sample is being returned as requested.

The submitted sample, designated as “Nylon Tulle Netting with Embroidery”, is an open-work warp knit fabric of 100% nylon which has been embroidered with glass beads and nylon tulle ribbon. The base fabric is an open-work raschel knit dyed fabric weighing approximately 59 g/m2 manufacture in approximately 165 centimeter widths. It has been embroidered by sewing glass beads and ribbon to the base fabric creating a floral motif.

The applicable subheading for the embroidered fabric will be 5810.92.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for embroidery in the piece, in strips or in motifs, other embroidery, of man-made fibers, other, other. Pursuant to additional U.S. Note 3 to Chapter 58 the duty rate for this product is not less than the rate which would apply to the base fabric. Since the base fabric is a warp knit fabric classifiable in subheading 6002.43.00, the rate of duty will be 11.2 percent ad valorem for the embroidered fabric.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
